Kevin Maclay Discusses Tort Liabilities at AIRA Advanced Restructuring & POR Conference
Since June 2019, three opioid manufacturers – Insys, Purdue, and Mallinckrodt – have filed for chapter 11, due in large part to the onslaught of litigation they have faced amidst the nationwide opioid epidemic. Unlike almost every other mass tort-induced chapter 11 filing prior thereto, the litigation that accelerated these chapter 11’s was brought mainly by “public” side plaintiffs – States and Political Subdivisions – as well as “private” side plaintiffs, such as personal injury victims. The objective of this panel – comprised of advisors to States, Political Subdivisions, Personal Injury Victims, and the Official Committee in each case, as well as one principal from the State of NY’s AG office – is to discuss key these issues as best as they can, given the sensitivities and then-current status of each of these cases.
