Overview

Kevin M. Davis is a Member in Caplin & Drysdale's Bankruptcy and Complex Litigation practice groups and is a cum laude graduate of the Georgetown University Law Center.

Services

Mr. Davis' principal practice area is complex commercial litigation, with a particular emphasis on creditors' rights and bankruptcy litigation. He has considerable experience representing official creditors' committees in asbestos, talc, and pharmaceutical mass tort bankruptcies, including those of Aldrich Pump and Murray Boiler; DBMP; Paddock Enterprises; Kaiser Gypsum and Hanson Permanente Cement; Cyprus Mines Corp.; Mallinckrodt Pharmaceuticals; Purdue Pharmaceuticals; The Fairbanks Company; ON Marine Services Company; Garlock Sealing Technologies; Duro Dyne Corporation; Sepco Corporation; Geo. V. Hamilton Co.; and City Homes, Inc.

Mr. Davis also represents individual and corporate clients in a diverse range of bankruptcy litigation matters across the country, including:

  • representing individual aviation crash victims in a fraudulent transfer and substantive consolidation action against a debtor’s insiders, successfully arguing an issue of first impression under California law in the process;
  • representing a consortium of major charitable foundations in the multi-million dollar purchase of historically significant items from a bankruptcy estate;
  • representing a governmental entity in advancing its creditor and lienholder rights in several high-profile energy company bankruptcies;
  • representing bankruptcy trust advisory committees in litigation to protect the privacy rights of individual tort victims in bankruptcy filings;
  • advising a telecommunications trade association on its rights vis-à-vis a member in Chapter 11 bankruptcy; and
  • counseling a major charitable foundation on issues arising from a Chapter 9 municipal bankruptcy.

Mr. Davis also represents individual and corporate clients in a diverse range of non-bankruptcy matters in state and federal courts across the country. In particular, Mr. Davis has substantial experience representing and advising exempt organizations, including charities, labor organizations, and trade associations in complex litigation and regulatory matters, and representing corporate clients in government investigations, litigation, and arbitration involving anti-corruption, government contracting, and antitrust issues.
